Genetic Difference and Social Policy: A Logical Dissection

The Sense and Reference of "Genetic Difference"

When Gottlob Frege distinguished between Sinn and Bedeutung—sense and reference—he gave us a tool far more powerful than most readers of his 1892 essay realized. The morning star and the evening star refer to the same object, Venus, yet they carry different cognitive content, different modes of presentation. I have spent eight years working through the consequences of this distinction for how we understand propositional attitudes, and I confess that I find no contemporary debate where the sense-reference distinction cuts more urgently than in the discourse surrounding genetic difference and social policy.

Consider the phrase "genetic difference." Its reference, if we are being strictly logical, points to measurable variation in DNA sequences across human individuals—single nucleotide polymorphisms, copy number variants, structural rearrangements. This is the Bedeutung: the objective state of affairs in the world to which the expression corresponds. But the Sinn, the mode of presentation under which that reference is grasped, shifts radically depending on context. When a medical geneticist speaks of genetic difference in relation to sickle cell trait, the sense is clinical, population-specific, and mechanistically precise. When a twentieth-century eugenicist spoke of genetic difference in the context of the Virginia sterilization campaigns of the 1920s, the sense was hierarchical, coercive, and fundamentally evaluative. Same reference class—human genetic variation—entirely different cognitive routes to it.

This is not a trivial semantic observation. The failure to separate sense from reference in genetic discourse has produced what I would call a category error of the first order: the conflation of descriptive biological variation with prescriptive social ranking. The involuntary sterilization programs in Virginia, which targeted individuals deemed genetically inferior and stripped them of reproductive autonomy, did not merely misuse genetic facts. They constructed an entirely different sense for those facts—one in which biological variation was presented under the aspect of moral hierarchy. The genetic data served as the reference point, but the sense through which that reference was mediated was an ideology of human worthiness.

My own work leans toward the view that much of the current paralysis in genetics policy stems precisely from this failure of logical hygiene. We have not adequately distinguished the proposition "genetic variation exists among humans" from the proposition "genetic variation licenses differential allocation of rights and resources." These two propositions share a subject term but differ in logical form, predicate structure, and—crucially—in their modal status. The first is an empirical generalization. The second is a normative prescription disguised as an empirical inference. Russell's theory of descriptions, which taught us to look beneath the grammatical surface of sentences to their true logical form, is indispensable here. The grammatical parallelism between "genes influence cognitive traits" and "genes determine who deserves freedom" masks a chasm in logical structure.
 

Genome Blindness: The Logic of Strategic Denial

The predominant institutional response to the legacy of eugenics has been what one prominent researcher at the University of Texas has termed "genome blindness"—the insistence that we should avoid studying, discussing, or politically acknowledging biological or genetic differences between people. The reasoning appears straightforward: if no genetic differences are recognized, then no genetic hierarchy can be constructed, and no eugenic policy can be justified.

I want to examine this reasoning with the care it deserves, because it contains a genuine philosophical problem alongside a practical failure. The logical structure of genome blindness resembles what Russell, in his 1905 paper "On Denoting," would recognize as a problematic definite description. The policy implicitly asserts: "The genetic differences that would ground eugenic hierarchy do not exist." But this formulation presupposes precisely what it seeks to deny. It treats "genetic differences" as a referring expression whose referent, if it existed, would automatically carry eugenic implications. The logical error is one of illegitimate quantifier scope: the denial is framed as though acknowledging the existence of genetic variation were logically equivalent to endorsing a hierarchy built upon it.

The empirical reality undermines this strategic denial. Survey data consistently shows that ordinary Americans, when asked how much genes influence intelligence, personality, or risk for mental illness, almost never answer "zero." People possess a working, pre-theoretical understanding that biological inheritance shapes human traits. Genome blindness does not eliminate this understanding; it merely drives it underground, removing it from the space of reasoned public deliberation. When the only voices willing to discuss genetic influence openly are the most extreme, the most hate-filled, the result is not the protection of vulnerable populations. The result is the ceding of an entire domain of inquiry to those who will interpret it in the worst possible way.

Here I must register a genuine disagreement with colleagues whose sympathies I otherwise share. Some philosophers of biology argue that genome blindness functions as a necessary political fiction—that even if the proposition "genetic differences exist and matter" is true, its public assertion causes sufficient social harm to warrant suppression. I understand the motivation, but I find this position logically untenable in the long run. A philosophy that depends on the strategic maintenance of false beliefs about the natural world cannot sustain itself. It corrodes the very epistemic foundations on which progressive policy must rest. If we cannot say true things about human biology without those truths being weaponized, the problem is not the truths. The problem is the interpretive framework within which they are received.

A narrower but instructive case crystallizes this point. In 2018, researchers at the University of Texas published genome-wide association studies identifying specific genetic variants correlated with educational attainment. The statistical effect sizes were minuscule—each variant contributing fractions of a percent to variance. Yet the public reception oscillated between two poles: outright dismissal ("genes have nothing to do with education") and triumphalist misreading ("intelligence is fixed at birth"). Neither response engaged the actual logical content of the research. The first denied the reference; the second accepted the reference but imposed a eugenic sense upon it. What was missing was the disciplined middle: acknowledging the finding while insisting that a statistical correlation at the population level licenses no inference about individual destiny, moral worth, or entitlement to resources.
 

From Predication to Legislation: The Policy Vacuum

The gap I worry about most is not primarily epistemological. It is institutional. Too much intellectual energy has been consumed by debates over the ethics of knowledge production—whether we should study genetic differences, whether certain research questions are permissible to ask—while the actual machinery of state-level policy operates with minimal philosophical scrutiny. The brass tacks of legislation, the state-by-state decisions about how genetic information may be collected, stored, used in insurance underwriting, or deployed in criminal justice contexts, proceed largely without the kind of conceptual clarity that analytic training provides.

A colleague's book, Predict and Surveil, documented how the Los Angeles Police Department integrated predictive policing algorithms and data aggregation into routine operations, resulting in the over-policing of specific communities. The data feeding these systems often originates from proprietary software provided by for-profit companies—opaque, unauditable, and structured by commercial incentives rather than public-interest constraints. The parallel to genetic data is direct and troubling. If polygenic risk scores, ancestry markers, or behavioral-genetic correlations enter proprietary databases controlled by profit-seeking entities, the interpretive frame shifts from scientific description to market valuation. The sense under which genetic information is presented is no longer "here is a fact about human biology" but "here is an asset to be monetized" or "here is a risk factor to be priced."

The dystopian scenario that concerns me least involves overt white nationalists marching with torches. The scenario that concerns me most involves a mid-level data broker in a glass office park selling aggregated genetic propensity scores to insurance companies, school admissions consultants, or employment screening firms—not out of ideological conviction, but because the revenue model supports it. This is eugenics without eugenicists: the hierarchical sorting of human beings by biological characteristics, executed not through state coercion but through market mechanisms so diffuse that no single agent bears moral responsibility for the outcome.

The logical structure of this problem mirrors what Frege identified as the context principle: a word has meaning only within the context of a proposition, and a proposition has truth-value only within the context of a system of judgment. Genetic data, extracted from the context of scientific inquiry and inserted into the context of commercial transaction, acquires a new sense. It is not the same proposition. The data points may be identical, but the logical role they play—the inferences they license, the policies they ground—transforms entirely.
 

Toward a Non-Eugenic Grammar of Human Variation

The constructive question, then, is whether we can articulate a grammar of genetic difference that preserves descriptive accuracy without generating eugenic entailments. I believe we can, though the task is harder than either the genome-blind denialists or the genetic determinists acknowledge.

The key distinction—drawn with precision in recent philosophical work on the topic—separates observing genetic differences from interpreting them eugenically. When we think about our intimate relationships, we routinely distinguish between what makes a person valuable, worthy of freedom, worthy of resources, worthy of consideration, and what our current economic system happens to reward. A parent does not love one child more because that child carries alleles associated with higher verbal fluency. A friend's worth is not indexed to their polygenic score for conscientiousness. We already possess, in the texture of ordinary moral life, the conceptual resources to hold biological facts and moral equality in the same cognitive space without allowing the former to erode the latter.

The challenge is transposing that distinction from the intimate to the institutional. It requires, at minimum, three structural commitments. The first is legislative: explicit statutory prohibitions on the use of genetic information in employment, insurance, and criminal sentencing decisions, enforced with penalties substantial enough to alter corporate cost-benefit calculations. The second is epistemic: sustained public investment in genetics education that teaches citizens not to fear genetic facts but to recognize the logical gap between a statistical association and a moral prescription. The third is architectural: public-interest governance of genetic databases, with transparent algorithms, community oversight boards, and strict prohibitions on proprietary data lock-up by for-profit entities.

None of these commitments requires genome blindness. None requires pretending that human biological variation is a fiction. What they require is the disciplined maintenance of a logical boundary: the boundary between the is of genetic description and the ought of social organization. That boundary is not a wall. It is a rule of inference—a constraint on what conclusions may be drawn from what premises. And maintaining rules of inference, insisting on valid deduction, refusing to let desire or ideology contaminate the chain from evidence to policy—this is what analytic philosophy, at its best, has always been about.

The linguistic turn in philosophy, which I have spent my career tracing from Frege's Begriffsschrift through Russell's logical atomism to its twentieth-century flowering, was never merely an academic exercise in parsing sentences. It was the recognition that how we speak shapes what we can think, and what we can think constrains what we can do. The language of genetics is being written right now—by researchers, by legislators, by data companies, by citizens forming intuitions about their own heredity. If we do not attend to the logical grammar of that language, if we allow the sense of "genetic difference" to collapse into the sense of "natural hierarchy," we will have repeated the twentieth century's catastrophe with twenty-first-century technology and none of the excuse of ignorance.

The task before us is not to look away from the genome. The task is to look at it clearly, describe it accurately, and refuse—with the full force of logical argument—to let any description smuggle in a prescription that no valid inference supports.
